Updated: Morganelli to Trump: Adopt DACA as Stand Alone Act

Northampton County District Attorney John Morganelli, who is also running for the Democratic nomination to Pa.'s 15th Congressional District, is calling on President Donald Trump to support DACA legislation without conditions and as a stand-alone bill.

DACA, or Deferred Action for Childhood Arrivals, is an immigration program adopted by President Barack Obama in 2012. He did so by executive order after the House refused to bring the matter up for a vote. It protects 800,000 "dreamers," who Morganelli described as "individuals who entered this country through no fault of their own. They were too young to make their own decisions."

To qualify for DACA protection, dreamers must be able to meet these minimum standards:

- Came to the United States before their 16th birthday
- Have lived continuously in the United States since June 15, 2007
- Were under age 31 on June 15, 2012 (born on June 16, 1981 or after)
- Were physically present in the United States on June 15, 2012, and at the time of making their request for consideration of deferred action with USCIS
- Had no lawful status on June 15, 2012
- Have completed high school or a GED, have been honorably discharged from the armed forces, or are enrolled in school
- Have not been convicted of a felony or serious misdemeanors, or three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety

Trump, who during his campaign had vowed to end DACA on "day one" of his presidency, ended it in September. But he suspended his Order for six months to "provide a window of opportunity for Congress to finally act." According to Department of Homeland Security Chief Kirstjen Nielson, Trump has no authority to grant any extension beyond March 5.

Morganelli, no friend to illegal immigration, distinguished dreamers from aliens who illegally enter this country to carry on a life of crime, not work. He said immigration resources should be focused on "removing dangerous foreign criminals," not dreamers.

He said Trump "is wrong in using these dreamers as hostages and human pawns in a chess match with the Democrats."

Morganelli, however, is opposed to forcing a government shutdown over this issue. He said that DACA supporters could find leverage in other ways.

Couldn't your headline just as well have been "Morganelli to Dems: Don't shut down government over DACA."

Anonymous said...

Simply say "NO" to illegal aliens who refuse to comply with the United States' immigration laws.

Nice to see Morganelli not worry about political capital, hold a tough and unpopular position, and not try to have it both ways.

We need guts like that in Washington.

"insert program" adopted by President (insert name) in (insert date). He did so by executive order"

If it brought heaven on earth I wound NOT want it done this way.

no one cares john - now go pull donchezs puppet strings if lisa will let you

6:02 Nailed it. And John, have you had to prosecute any so-called dreamers?

Bernie O'Hare said...

Really? His news conference was covered by The Morning Call, WFMZ and Channel 10. No congressional candidate, D or R, enjoys that kind of access. He is your next Congressman, and you’ll still be a snide, anonymous troll.

Better luck next year. You were not mentioned on the fake news awards.

Bernie O'Hare said...

Once he's impeached by a Democratic Congress, we can call Trump a fake President.

Geez, Bernie, per 9:25 you are "the enemy of the people." I watched a video of GOP Sen. Flake's speech today re Trump, truth, and the freedom of the press. Pretty good if you have not watched. Per these so called fake news awards that were later on the GOP site, as Sen. Flake earlier said, "of course, a major difference between politicians and the free press is that the press usually corrects itself when it gets something wrong. Politicians don't." But hey, the GOP continues to be complicit no matter how outrageous Trump pushes the envelope. The larger quote from Goebbels' "big lie" quote ends "..for the truth is the mortal enemy of the lie, and thus by extension, the truth is the greatest enemy of the State." ... I know, I know, its all "fake news!"

Anyway, back to topic of the post, the reality is that immigration LAW is legislated by Congress, and enforced by the executive branch. Congress, as it has done SO often the past few decades, prefers to abdicate its legislative responsibilities, forcing both Dem and GOP presidents to either do nothing or stretch their constitutional authority via Executive Orders, hence the birth of DACA in the first place. As much as I do not like Trump, despite holding my nose to vote for him (once), he rightfully punted to Congress and gave them 6 months to ... do absolutely nothing on DACA. The shame is really on the Congress, which Morganelli is running for. Thanks to PA gerrymandering, my part of the Lehigh Valley is no longer part of the 15th, so I can only wish him well.

Morganelli is such a phony political opportunist. This shows he is just like every other politician. He was against illegal immigration and tweeting that at Trump. Now that he is in a D primary though, he is all for the illegal dreamers. Give me a break!

Ovem Lupo Commitere said...

and IF Morganelli can survive a Dem primary, the story out of Wisconsin today of a state senate district that has been solidly GOP, and double digit for Trump, went for the Democrat. Personally, like many, I am in an anti-GOP/Trump frame of mind, not necessarily a pro-Democrat (and I hate that for the past several years, regardless of party, I feel like too often I have been voting "against" rather than "for"). Anyway, my concern is that Dems will be their own worst enemy if they swing to hard to the left. Opportunities are before them if they can be smart about it. Otherwise, America will just get whiplash vacillating between the L and the R. It wasn't that long ago that "centrist" was an attribute, whether center-left or center-right.

"Morganelli is such a phony political opportunist."

Political opportunists do not take shots at the PSP, as he did over their investigation of themselves in a police shooting.

John has always supported the dreamers. I asked him about this some time ago. Unless you are an idiot, there is a difference between a person who came her as a child and did nothing wrong, and one who comes here as an adult, and for the express purpose of committing crimes.

and yet trump has to be cruel in his efort.
https://www.usatoday.com/story/news/nation-now/2018/01/15/deported-after-30-years/1034668001/

"An undocumented family member brought Jorge Garcia to the U.S. when he was 10 years old. Today he has a wife and two children, all of whom are U.S. citizens."
"Jorge Garcia had been facing an order of removal from immigration courts since 2009, but under the previous administration, he had been given stays of removal. Because of the Trump administration's crackdown on immigration, in November Jorge Garcia was ordered to return to Mexico.

His supporters say he has no criminal record — not even a traffic ticket — and pays taxes every year."

he is too old to even apply for DACA.

at one time the US used to be the humanitarian leader of the world.
how could anyone think removing this man will make America great?

To paraphrase the late Senator Everett Dirksen, an amnesty here, an amnesty there, and pretty soon, you're talking real majorities.

Anonymous said...

Morganelli is just spouting the democratic line, reform is needed now, if legalized, these dreamers will be able to bring in as many as 8 million new immigrants through chain migration. including their parents who broke the law by bringing in them. no more amnesty. This DACA is just another ploy to change the electorate to win elections.

To remind everyone, the term "Dreamers" are a euphemism coined by the Democrats for a group of illegal aliens.

In addition, "those who enter the country illegally, and those who employ them disrespect the rule of law. They are showing disregard for those who are following the law. We simply cannot allow people to pour into the United States undetected, undocumented, unchecked and circumventing the line of people who are waiting patiently and lawfully to become immigrants."
- Senator Barack H. Obama, 2005.

and if Comrade trump wants to deport all the illegals, that means moving 8 to 10 million people.
what happens when they decide not to leave?
going to shoot people in the streets?

Anonymous said...

also how are you going to get all those illegal Irish deported when they blend in with the general population?
guess every time a citizen with an Irish name gets stopped by the police they must run an immigration check on those folks and hold them until verified.
sounds like a "papers please" law has to be passed so white folks have to prove they are citizens.
after all if an illegal Irish guy slips through the net well that just cannot be tolerated.

and when do the children of illegals get to decide to break the law?
another point.
currently there is no talk about cracking down on employers who hire illegals.
if an employer gets caught "knowingly" accepting a bogus SSN the fine is 250 dollars last i checked.
besides when Arizona decided to pass SB1070 or papers please law the one group that objected was the Arizona chamber of commerce.they felt if Arizona enacted that law then Arizona would not be able to compete on wages with other border states.
translated --business would not have cheap exploitable labor like other states.

so where are the Republicans demanding that business owners who hire illegals should be punished?

A stand alone bill, what is he nuts or has he given into the Schummer/Pelosi line of thinking. What we need is a comprehensive Immigration bill that will end the DACA equation, destroy chain migration, throw out the idiotic lottery and semi-fund a wall. The democrats are the group holding this back because they want to swell the coffers for entitlements. Get real!

Anonymous said...

The democrats want to keep the DACA deal that they have now, which is those effected people must renew every three years and do not have a permanent status. They want to keep it this way so they can pull their chain whenever they want to. The presidents proposal that would reform chain migration, the visa lottery and provide for border security would be coupled with a real and permanent status for these people. The democrats think it is better for them to keep them dependent and not really free.

"semi-fund a wall"---Comrade trump has stated numerous times that Mexico will pay for the wall.
so was donnie lying again?
chain migration was and is quite common in the history of immigration to the US.
it worked for Italian and Irish and even Mexican immigrants.an example would be
https://en.wikipedia.org/wiki/New_Glarus,_Wisconsin

so the right wing is chomping at the bit so the "dreamers" are made citizens?
i must have missed that memo from the RNC.

Immigrants needed to have sponsors that would pledge to support them. it was usually immediate family.

BUY THOSE VOTES JOHN ! BECOMING THE TYPICAL POLITICIAN LIKE A FISH OUT OF WATER " FLOOPING ALL OVER THE PLACE". TURN COAT.

John Morganelli is part of the Prison Industrial Complex that has been incarcerating our young people, particularly those from disadvantaged communities. This is not the face of today's Progressive Democratic party.

Bernie O'Hare said...

No, he's not. That's why he'll be elected. He thinks like 15th Pa Congressional District people. He is a centrist.

Anonymous said...

Why no story Bernie about the better than 50% chance the State Supreme court is going to overturn the current Election maps and that the 15th district will likely be redrawn before November.

Bernie O'Hare said...

Hey asshole, I have written four stories over the past 24 hours. If you want more reported, send me your stories with your name or start your own blog.

12:14 If you're hoping the maps will be re-drawn, remember the Republicans control the General Assembly and Senate in Harrisburg. If I were them and forced to re-draw the district maps, I'd gerrymand them even more than they are now to insure the Democrats go down the rathole come election time.

Anonymous said...

IF they are redrawn they would have to be approved by the Supreme court if they did that the court would install it's own maps

Anonymous said...

To be very honest I can't image a map that is any more Gerrymander than this one

John won't get past his own primary. Doesn't he realize that - according to a DNC memo leaked last week - unrestricted immigration is essential to his party's future electoral prospects? He's also a communion-receiving Catholic who recites, "Lord hear our prayer," when his parish prays during the Prayer of the Faithful at Mass for public officials to uphold the sanctity of life from conception to natural death. The old "I'm personally opposed ..." canard doesn't remove his responsibility. In fact, it makes his degree of scandal worse, by the Dominican standard. Voters seem to be more understanding of radical pro-abortion politicians, like Charlie Dent, than they are of those who peddle the explanation John is.

Bernie O'Hare said...

John will be the next Congressman for Pa.'s 15th Congressional District. That's just the way it is. How many candidates do you know who can call a news conference and have TV camera and reporters come and publish his statements? He already has the advantage of an incumbent.

Anonymous said...

12:38 the Court has no power or authority to create legislative districts. That's a function of the General Assembly. The court can only rule on the constitutionality of such maps.

The fact is that the current maps will remain in effect until they are replaced with new ones. That's how it works.

It's a good thing that representatives are elected by the voters and not by their ability to draw the press and reporters. Otherwise Hillary Clinton would be in the White House, as that's all that attended her rallys.
